Terms of Service

The agreement between you and CalcNex governing your use of the Platform

These Terms of Service ("Terms") govern your access to and use of the CalcNex engineering calculation platform ("Platform") operated by CalcNex ("we", "us", "our"), an Australian sole trader business.

By registering an account, accessing the Platform, or clicking "I agree", you confirm that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation.

If you do not agree to these Terms, do not use the Platform.

1. The Platform

CalcNex is a cloud-based software platform providing structural and geotechnical engineering calculation modules including TerraPile (pile group analysis) and future modules as released. The Platform is accessible via app.calcnex.com.au.

⚠️ Professional Use Notice: CalcNex is a calculation tool designed to assist qualified engineers. All outputs must be reviewed and verified by a suitably qualified and registered engineer before use in any design, construction, or professional submission. CalcNex does not replace professional engineering judgement.

3. Subscriptions and Plans

3.1 Free Trial

New accounts receive a 31-day free trial with full access to the Platform. No credit card is required during the trial period. At the end of the trial, access to the Platform will be restricted unless you subscribe to a paid plan.

3.2 Paid Plans

Paid subscription plans are available on a monthly basis:

All prices are in Australian dollars (AUD) and exclude GST. Subscriptions are billed monthly in advance via Stripe.

3.3 Seat Limits

Each subscription plan includes a maximum number of user seats: Free (1 seat), Essential (1 seat), Professional (2 seats), Enterprise (4 seats). A "seat" is defined as a unique login used to access the Platform. Concurrent use of the same credentials beyond your plan's seat limit may result in access being blocked. If your usage exceeds your plan's seat limit, you must upgrade to a higher plan.

3.4 Future Modules

Your subscription covers access to all CalcNex modules available during your subscription period, including new modules released while your subscription is active, at no additional cost.

7. Intellectual Property

7.1 Our intellectual property

CalcNex and all its content, features, algorithms, calculation methods, source code, designs, and trademarks are the intellectual property of CalcNex. You may not copy, reproduce, or create derivative works from any part of the Platform without our written consent.

7.2 Your project data

You retain full ownership of the engineering project data you create and store on the Platform. By using the Platform, you grant us a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the Platform to you.

8. Disclaimer of Warranties

Important: The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that calculation results are error-free, complete, or suitable for any specific engineering application. All results must be independently verified by a qualified engineer.

To the maximum extent permitted by Australian law, we disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, CalcNex's total liability to you for any claim arising from your use of the Platform is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or engineering outcomes arising from your use of or reliance on the Platform.

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)).

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect, and update the "Last updated" date on this page. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
